LICENSE AGREEMENT
This Agreement is available in English, Spanish, and Russian. In case of any discrepancies or conflicts in interpretation, the English version shall prevail as the official and legally binding version.
1. Introduction
Welcome to Englexs Academy, owned and operated by Daniela Levi. By enrolling in our language courses on englexs.com, ru.englexs.com, es.englexs.com you agree to comply with the terms and conditions outlined in this License Agreement ("Agreement"). Please read this Agreement carefully before accessing or using our courses.
2. Regulatory Framework
These General Terms and Conditions shall be governed by applicable international consumer protection and e-commerce laws. Englexs Academy complies with all relevant legal provisions concerning electronic contracting, consumer rights, and data protection in the jurisdictions where it operates.
3. Prices and Taxes
The STUDENT agrees to pay Englexs Academy the specified course fees at the time of purchase, as listed on the Englexs Academy website. All applicable taxes and fees will be included in the final purchase price before completing the transaction.
4. Enrollment and Access
- Eligibility: Enrollment is open to individuals worldwide.
- Course Access: Upon successful enrollment and payment, unlimited access to the purchased course will be granted.
- Non-Transferable: Course access is strictly personal and non transferable.
By enrolling, the STUDENT acknowledges acceptance of these terms.
5. Purchase Procedure
To enroll in a course on the Englexs Academy website, the STUDENT must complete the following steps:
- Course Selection
The STUDENT selects the desired course on the Englexs Academy website.
- Currency Selection
The STUDENT selects the preferred payment currency available on the website.
- Order Submission
The STUDENT provides the required personal information, including full name and email address.
- Acceptance of Legal Terms
By completing the purchase, the STUDENT confirms acceptance of the License Agreement and Privacy Policy.
- Payment Processing
The STUDENT enters payment details and confirms the transaction through the selected payment provider.
- Payment Confirmation and Contract Formation
The contract between the STUDENT and Englexs Academy is considered concluded once the payment has been successfully processed.
- Account Activation
Within 24 hours of successful payment, the STUDENT will receive an email invitation containing login credentials (username and password) to access their course account.
- Course Access
The STUDENT is granted access to the purchased course upon account activation and may use the course for the duration specified in the License Agreement.
6. Refund Policy
- Eligibility for Refund: You are eligible for a refund if you request it within two weeks (14 days) from the date of purchase, provided you have not completed more than four modules of the course. Refund
- Request Process: To initiate a refund, you must send an email to mail@englexs.com with your full name, course name, purchase date, and a brief explanation for the refund request.
- Refund Method: Approved refunds will be processed using the original method of payment within 14 business days of approval.
7. Obligations of the Student
The STUDENT agrees to use the Service and its accessible content in good faith, following applicable laws and respecting third-party rights.
The STUDENT shall not:
- Use the Service or its content for commercial or public purposes.
- Use the Service or its content for illegal or inappropriate purposes.
- Reproduce, distribute, or modify the Service or its content in violation of intellectual property laws.
- Circumvent, modify, or remove any security measures protecting the Service or its content.
- Attempt to breach the security of the Service or its content.
- Infringe the rights of Englexs Academy or third parties.
Failure to comply may result in suspension of service, and Englexs Academy reserves the right to claim compensation for damages caused.
8. Obligations of Englexs Academy
Englexs Academy commits to delivering high-quality educational services and maintaining the necessary infrastructure for their operation. However, uninterrupted service cannot be guaranteed due to unforeseen technical or network issues. Englexs Academy has implemented industry-standard security measures to protect the website and its users but cannot be held responsible for damages resulting from external security breaches beyond its control.
9. Force Majeure
Neither party shall be held liable for failure to fulfill obligations if service is delayed or impossible due to Force Majeure events (e.g., natural disasters, cyberattacks, pandemics, or government restrictions). The affected party must notify the other within 48 hours and take reasonable steps to resolve the issue. If Force Majeure persists beyond three months, the unaffected party may terminate the contract with a fifteen (15) day notice.
10. Intellectual Property
- All course materials, including videos, texts, software, and resources, are the exclusive intellectual property of Englexs Academy and are protected by international copyright laws.
- The STUDENT receives a non-exclusive, non-transferable license to use course materials for personal learning only.
- Unauthorized copying, distribution, modification, or reverse engineering of Englexs Academy’s intellectual property is strictly prohibited.
- The STUDENT must not remove, alter, or bypass any security measures or copyright notices embedded in the course materials.
11. Indemnification
The STUDENT agrees to indemnify and hold Englexs Academy harmless from any claims, losses, or demands resulting from a violation of this Agreement.
12. Assignment
Englexs Academy reserves the right to transfer its rights and obligations under this Agreement to third parties, provided that such parties fulfill the contractual obligations.
13. Agreement Perfection and Service Modifications
The Agreement becomes effective upon payment confirmation. Englexs Academy reserves the right to update the course content and the terms of service. The Englexs Academy may enhance the courses by adding new valuable materials, updating information, and enriching the educational content in order to improve the quality and relevance of the learning experience.
14. Severability
If any provision of this Agreement is deemed invalid, the remainder shall remain enforceable.
15. Breach of Contract
Englexs Academy may suspend or terminate access if the STUDENT violates this Agreement. Serious infractions may be reported to the relevant authorities. Englexs Academy's failure to act against a violation shall not be considered a waiver of its rights to enforce compliance at a later date.
16. Disputes and Complaints
If the STUDENT is dissatisfied, they may file a complaint via mail@englexs.com. Both parties will first attempt to resolve any disputes amicably through direct communication. If this does not resolve the issue, the parties agree to engage in mediation or arbitration as a next step, before considering any court involvement. All efforts will be made to resolve the dispute without resorting to litigation.
17. Governing Law
This Agreement is governed by international consumer protection standards. In the event of any dispute that cannot be resolved amicably through direct communication, the parties agree to first seek resolution through mediation or arbitration, as mutually agreed. If the dispute remains unresolved after these steps, it shall be resolved in accordance with applicable international laws, unless mandatory consumer protection laws in the STUDENT'S country of residence provide otherwise.

22. Additional Provisions
The text of this Offer may be modified unilaterally by the Englexs Academy at any with the updated version available at: https://englexs.com/docs/oferta. The terms of the Agreement remain unchanged for the STUDENT who accepted the Offer before modifications. The STUDENT agrees to the processing of personal data under the Privacy Policy available at: https://englexs.com/docs/policy.

4. Inscripción y Acceso

5. Procedimiento de Compra
Para inscribirse en un curso en el sitio web de Englexs Academy, el ESTUDIANTE debe completar los siguientes pasos:
- Selección del curso
El ESTUDIANTE selecciona el curso deseado en el sitio web de Englexs Academy.
- Selección de moneda
El ESTUDIANTE selecciona la moneda de pago preferida disponible en el sitio web.
- Envío del pedido
El ESTUDIANTE proporciona la información personal requerida, incluido su nombre completo y dirección de correo electrónico.
- Aceptación de los términos legales
Al completar la compra, el ESTUDIANTE confirma la aceptación del Acuerdo de Licencia y la Política de Privacidad.
- Procesamiento del pago

- Confirmación del pago y formación del contrato
El contrato entre el ESTUDIANTE y Englexs Academy se considera concluido una vez que el pago se ha procesado con éxito.
- Activación de la cuenta
Dentro de las 24 horas posteriores al pago exitoso, el ESTUDIANTE recibirá un correo electrónico con la invitación que contiene las credenciales de acceso (nombre de usuario y contraseña) para acceder a su cuenta del curso.
- Acceso al curso
El ESTUDIANTE obtiene acceso al curso adquirido tras la activación de la cuenta y podrá utilizar el curso durante el período especificado en el Acuerdo de Licencia.
6. Política de Reembolsos
- Elegibilidad para Reembolso: Tiene derecho a un reembolso si lo solicita dentro de las dos semanas (14 días) posteriores a la compra, siempre que no haya completado más de cuatro módulos del curso.
- Proceso de Solicitud: Para solicitar un reembolso, debe enviar un correo electrónico mail@englexs.com con su nombre completo, nombre del curso, fecha de compra y una breve explicación.
- Método de Reembolso: Los reembolsos aprobados se procesarán utilizando el mismo método de pago original dentro de los 14 días hábiles posteriores a su aprobación.
7. Obligaciones del Estudiante
El ESTUDIANTE se compromete a utilizar el Servicio y su contenido accesible de buena fe, cumpliendo con las leyes aplicables y respetando los derechos de terceros. No deberá:
- Usar el Servicio o su contenido con fines comerciales o públicos.
- Usar el Servicio o su contenido con fines ilegales o inapropiados.
- Reproducir, distribuir o modificar el Servicio o su contenido en violación de las leyes de propiedad intelectual.
- Eludir, modificar o eliminar medidas de seguridad del Servicio o su contenido.
- Intentar violar la seguridad del Servicio o su contenido. Infringir los derechos de Englexs Academy o de terceros.
El incumplimiento puede dar lugar a la suspensión del servicio, y Englexs Academy se reserva el derecho de reclamar daños y perjuicios.
8. Obligaciones de Englexs Academy
Englexs Academy se compromete a ofrecer servicios educativos de alta calidad y a mantener la infraestructura necesaria para su funcionamiento. Sin embargo, no se garantiza la disponibilidad ininterrumpida debido a problemas técnicos o de red imprevistos. Se han implementado medidas de seguridad estándar, pero Englexs Academy no se hace responsable de daños causados por brechas externas fuera de su control.
9. Fuerza Mayor
Ninguna de las partes será responsable por el incumplimiento debido a eventos de Fuerza Mayor (ej. desastres naturales, ciberataques, pandemias, restricciones gubernamentales). La parte afectada debe notificar dentro de las 48 horas e intentar resolver el problema. Si persiste por más de tres meses, la otra parte puede rescindir el contrato con 15 días de aviso.
10. Propiedad Intelectual
Todo el contenido del curso es propiedad exclusiva de Englexs Academy y está protegido por leyes internacionales de derechos de autor. El ESTUDIANTE recibe una licencia no exclusiva e intransferible para uso personal. Está prohibida la copia, distribución, modificación o ingeniería inversa no autorizada. No debe eliminar, alterar ni eludir medidas de seguridad ni avisos legales.
11. Indemnización
El ESTUDIANTE acepta indemnizar a Englexs Academy ante cualquier reclamo, pérdida o demanda derivada de una violación de este Acuerdo.
12. Assignment
Englexs Academy se reserva el derecho de transferir sus derechos y obligaciones a terceros, siempre que estos cumplan con las condiciones contractuales.
13. Perfección del Acuerdo y Modificaciones del Servicio
El Acuerdo entra en vigor una vez confirmado el pago. Englexs Academy se reserva el derecho de actualizar el contenido del curso y las condiciones del servicio. Englexs Academy podrá mejorar los cursos mediante la incorporación de nuevos materiales valiosos, la actualización de la información y el enriquecimiento del contenido educativo con el fin de mejorar la calidad y relevancia de la experiencia de aprendizaje.
14. Nulidad parcial
Si alguna cláusula se considera inválida, el resto del Acuerdo seguirá vigente. 15. Incumplimiento del Contrato Englexs Academy podrá suspender o terminar el acceso si el ESTUDIANTE incumple este Acuerdo. Las infracciones graves pueden ser reportadas a las autoridades correspondientes. El hecho de que Englexs Academy no actúe ante una infracción no se considerará una renuncia a su derecho de hacer cumplir el cumplimiento en una fecha posterior.
16. Disputas y Reclamaciones
Si el ESTUDIANTE no está satisfecho, puede presentar una queja enviando un correo a mail@englexs.com. Ambas partes intentarán primero resolver cualquier disputa de manera amistosa mediante comunicación directa. Si esto no resuelve el problema, las partes acuerdan recurrir a mediación o arbitraje como siguiente paso, antes de considerar acudir a los tribunales. Se harán todos los esfuerzos posibles para resolver el conflicto sin llegar a un litigio.
17. Ley Aplicable
Este Acuerdo se rige por los estándares internacionales de protección al consumidor. En caso de cualquier disputa que no pueda resolverse de manera amistosa mediante comunicación directa, las partes acuerdan buscar primero una solución a través de mediación o arbitraje, según mutuo acuerdo. Si la disputa no se resuelve después de estos pasos, se resolverá de acuerdo con las leyes internacionales aplicables, a menos que las leyes obligatorias de protección al consumidor en el país de residencia del ESTUDIANTE dispongan lo contrario.

Englexs Academy es propiedad y está operada por Daniela Levi, empresaria individual, número de registro 324784700252580. Todas las obligaciones contractuales y financieras bajo este Acuerdo son gestionadas por Daniela Levi de conformidad con las leyes internacionales de protección al consumidor aplicables.

3. Цены и налоги
СТУДЕНТ обязуется оплатить Englexs Academy указанную стоимость курса в момент покупки, как указано на сайте. Все применимые налоги и сборы включаются в окончательную цену перед завершением покупки.
4. Регистрация и доступ
- Допуск: Регистрация доступна для лиц по всему миру.
- Доступ к курсу: После успешной оплаты предоставляется неограниченный доступ к курсу.
- Непередаваемость: Доступ предоставляется исключительно для личного использования и не подлежит передаче.
Регистрируясь, СТУДЕНТ подтверждает согласие с условиями.
5. Процедура покупки
Чтобы записаться на курс на сайте Englexs Academy, СТУДЕНТ должен выполнить следующие шаги:
- Выбор курса
СТУДЕНТ выбирает желаемый курс на сайте Englexs Academy.
- Выбор валюты
СТУДЕНТ выбирает предпочтительную валюту для оплаты, доступную на сайте.
- Отправка заказа
СТУДЕНТ предоставляет необходимую личную информацию, включая полное имя и адрес электронной почты.
- Принятие юридических условий
Завершая покупку, СТУДЕНТ подтверждает принятие Лицензионного соглашения и Политики конфиденциальности.
- Обработка платежа
СТУДЕНТ вводит платежные данные и подтверждает транзакцию через выбранного платежного провайдера.
- Подтверждение платежа и заключение договора
Договор между СТУДЕНТОМ и Englexs Academy считается заключенным после успешной обработки платежа.
- Активация аккаунта
В течение 24 часов после успешного платежа СТУДЕНТ получит электронное письмо с приглашением, содержащим учетные данные (имя пользователя и пароль) для доступа к своему аккаунту курса.
- Доступ к курсу
СТУДЕНТ получает доступ к приобретенному курсу после активации аккаунта и может использовать курс в течение периода, указанного в Лицензионном соглашении.
6. Политика возврата
- Право на возврат: Вы имеете право на возврат средств в течение 14 дней после покупки, если не прошли более четырёх модулей курса.
- Процедура возврата: Отправьте письмо на mail@englexs.com с указанием полного имени, названия курса, даты покупки и кратким объяснением причины возврата.
- Метод возврата: После одобрения возврат осуществляется тем же способом оплаты в течение 14 рабочих дней.
7. Обязанности Студента
СТУДЕНТ обязуется использовать Сервис и его контент добросовестно, соблюдая действующее законодательство и права третьих лиц. Запрещается:
- Использовать Сервис или контент в коммерческих целях;
- Использовать Сервис или контент для незаконной или недопустимой деятельности;
- Копировать, распространять или изменять контент с нарушением авторских прав;
- Обходить, изменять или удалять защитные механизмы Сервиса;
- Пытаться нарушить безопасность Сервиса;
- Нарушать права Englexs Academy или третьих лиц.
При нарушении условий Соглашения доступ может быть приостановлен, и Englexs Academy оставляет за собой право на возмещение убытков.
8. Обязанности Englexs Academy
Englexs Academy обязуется предоставлять качественные образовательные услуги и поддерживать необходимую инфраструктуру. Однако не гарантируется бесперебойная работа сервиса из-за возможных технических или сетевых сбоев. Применяются стандартные меры безопасности, но компания не несёт ответственности за внешние нарушения, находящиеся вне её контроля.
9. Форс-мажор
Стороны освобождаются от ответственности за неисполнение обязательств по причинам форс-мажора (стихийные бедствия, кибератаки, пандемии, государственные ограничения и пр.). Пострадавшая сторона должна уведомить другую в течение 48 часов. Если ситуация продолжается более трёх месяцев, другая сторона вправе расторгнуть договор с 15-дневным уведомлением.
10. Интеллектуальная собственность
Все материалы курсов, включая видео, тексты, программное обеспечение и ресурсы, являются исключительной интеллектуальной собственностью Englexs Academy и защищены международным законодательством об авторских правах. СТУДЕНТ получает неисключительную, непередаваемую лицензию на использование материалов курса исключительно в личных образовательных целях. Несанкционированное копирование, распространение, изменение или обратное проектирование интеллектуальной собственности Englexs Academy строго запрещено. СТУДЕНТУ запрещается удалять, изменять или обходить любые средства защиты или уведомления об авторских правах, встроенные в материалы курса.
11. Возмещение убытков
СТУДЕНТ обязуется возместить Englexs Academy все убытки, вызванные нарушением настоящего Соглашения. СТУДЕНТ соглашается возместить Englexs Academy любые претензии, убытки или иски, возникшие в результате нарушения настоящего Соглашения.
12. Передача прав и обязанностей
Englexs Academy вправе передавать свои права и обязанности третьим лицам, при условии соблюдения всех обязательств.
13. Заключение соглашения и изменения в сервисе
Соглашение вступает в силу после подтверждения оплаты. Englexs Academy вправе обновлять содержание курсов и условия предоставления услуг. Englexs Academy оставляет за собой право улучшать курсы, включая добавление нового полезного материала, обновление информации, а также расширение образовательного контента в целях повышения качества обучения и актуальности курса.
14. Делимость положений
Если какое-либо положение признаётся недействительным, остальные положения сохраняют силу. 15. Нарушение условий договора Englexs Academy может приостановить или прекратить доступ в случае нарушения настоящего Соглашения СТУДЕНТОМ. Серьёзные нарушения могут быть переданы в соответствующие органы. Бездействие Englexs Academy в ответ на нарушение не считается отказом от её права добиваться соблюдения условий Соглашения в будущем.
16. Споры и жалобы
Если СТУДЕНТ остаётся недоволен, он может направить жалобу на mail@englexs.com. Стороны предпримут попытки урегулировать спор мирным путём посредством прямой коммуникации. Если это не решит проблему, стороны согласны прибегнуть к медиации или арбитражу как к следующему этапу, прежде чем обращаться в суд. Все усилия будут направлены на разрешение спора без судебного разбирательства.
17. Применимое право
Настоящее Соглашение регулируется международными стандартами защиты прав потребителей. В случае возникновения спора, который не может быть урегулирован мирным путем посредством прямого общения, стороны соглашаются сначала попытаться разрешить его через медиацию или арбитраж по взаимному соглашению. Если после этих действий спор остаётся нерешённым, он подлежит разрешению в соответствии с применимыми международными нормами, если только обязательные нормы защиты прав потребителей в стране проживания СТУДЕНТА не предусматривают иное.

Для СТУДЕНТA, принявшего Оферту ранее, условия не изменяются. СТУДЕНТ соглашается на обработку персональных данных согласно Политике конфиденциальности: https://englexs.com/docs/policy.
